Terms and Conditions
Please read these terms and conditions
in their entirety prior to ordering goods. Security
New Zealand Sailing realise that
one of the greatest worries that people have about purchasing on the web
is that of security. The New Zealand Sailing Website is scanned
on a daily basis by a specialist outside company to ensure that there are
no known hacker vulnerabilities, ensuring that the data you enter stays
secure.

We also
offer secure payment options - You can choose to either phone New
Zealand Sailing with your credit card details for manual entry
through our credit card terminal or to pay on-line using a payment
gateway. Our payment gateway is provided by the BNZ; they provide secure
online credit card and debit card payment solutions for thousands of
online and mail order businesses across NZ and are the one of
largest Payment Service Providers in the country. BNZ solely
handles your card details on their secure server where they run extensive
security checks and obtain card authorisation. The merchant (New
Zealand Sailing Ltd) never has access to your credit card details.
The only information that New Zealand Sailing holds on you is
information for the purposes of ordering and/or the opt-in mailing list.
This user information is held in our database that is not directly
accessible from the web. If you have any worries about security please
feel free to contact
us. Prices
All prices are in NZ dollars
and include GST @ 12.5%. We will try to maintain the price as
advertised but we reserve the right to change before you place an order.
Orders for outside the NZ will have GST deducted from the total and
this is most cases will cover the postage and the import duties will be the
responsibility of the purchaser. Product prices in the shopping cart
exclude delivery charges. The carriage costs are calculated during the
checkout process and are dependant on the size of the order and the
destination. Product Descriptions
New Zealand Sailing attempt to be
as accurate as possible. However, NZ Sailing does not warrant that
product descriptions or other content of this site is accurate, complete,
reliable, current or error-free. If a product offered by NZ Sailing
is not as described, your sole remedy is to return it in unused
condition.
Delivery
NZ Sailing aim to process your
order as soon as possible, generally we process orders placed on a working
day before 1200hrs on that day. However, during busy periods your order
may not be processed until the next working day after it was placed.
Average delivery times for 'in stock' items are 3-4 working days from
receipt of order. Where possible we offer an express delivery service
whereby, if the order has been received by 1200hrs on a working day, we
will process the order that day and ship on a next working day service.
However, it should be noted that occasionally our couriers experience
operational difficulties and therefore this is not a guaranteed
service.
Cancellation period
Customers have the right to cancel any
order for stock items up to 7 days after the day the goods were delivered,
the customer is responsible for returning the goods to NZ Sailing
before repayment can be made, NZ Sailing will refund the cost of
the goods (not any postage) within 30 days of cancellation, providing the
goods have been returned unused, undamaged and fit for re-sale. NZ
Sailing reserve the right to charge a handling charge

Returns Policy
All returned goods must be accompanied
with a returns form which is downloadable from the returns section of our website. NZ
Sailing do not accept any responsibility for paying the costs
involved in returning goods to rooster HQ. The costs incurred in sending
unwanted items back to rooster are the responsibility of the customer, we
also advise that proof of postage is obtained as we are not liable for
items lost in transit and ask that original packaging is returned.
All NZ Sailing products can be returned to us for an exchange or
refund if they are in as-sold condition and in original packaging, within
7 days of receipt. If you would like to return an item and it is outside
the 7 day period, you have up to three months to send the goods back to us
for a credit note or an exchange. Returned goods are inspected in our
returns department and replacements, exchanges, credits or refunds are
carried out within 7 working days and replacement goods are subject to
availability.
Faulty Products
If you believe a product of ours to be
faulty from the point of sale you have 3 weeks to reject the product. The
item must be in unused condition and with proof that the product has a
manufacturing fault that was present at the point of sale. It is our
decision as to how we deal with the fault, be it discount off an identical
product or in-house repair, the customer will be informed via email or
telephone as to our decision.
NZ
Sailing Product Guarantee’s
All products have their normal
manufacturers warranty. NZ Sailing’s own manufactured products, such
as the Rooster DS layering system clothing range, are all guaranteed
against faulty workmanship or materials for six months, excluding normal
wear and tear.
Delays
The time for completion of our work
and completion of orders is given in good faith, but is not
guaranteed. NZ Sailing shall not be responsible for any delay unless
it arises from our wilful acts or negligence.
Sub-contracting
We may sub-contract all or part of the
work entrusted to us by the customer, on terms that any such
sub-contractor shall have all the rights and benefits contained in these
Terms and Conditions. Where we exercise this right we shall remain
responsible to the customer for the performance of our
subcontractor.
Stock Levels
All of our products are offered
subject to availability. If for any reason we cannot supply you with any
part of your order, we will contact you via email or telephone to advise
you. We may need to cancel or refund the item from your order, if funds
have been debited, they will be refunded back to the source of
payment.
Environmental Policy
It is part of our environmental policy
that we use recycled materials such as used cardboard boxes and bubble
wrap for our customers goods packaging. All the packaging that is
un-useable is recycled also.
Privacy
NZ Sailing holds information on
its customers collected at the time of ordering for the processes of
fulfilling the orders made. Customers are also given the opportunity to
join a mailing list, this is optional and this can be done when placing an
order or through link on the website. We WILL NOT pass your name and
address to ANY third parties. All newsletter e-mails sent will include
instructions of how to remove yourself from the mailing list.
Your statutory rights are not affected
by these terms and conditions.
